This happens more often than people expect. You were in a car accident, you did what you were supposed to do, and then you found out the other driver either had no insurance or left the scene altogether. At that point, most people assume the case is over.

In many situations, it isn't.

If the other driver left the scene (hit and run)

If the other driver fled the scene, it is often because they did not have insurance. Even so, that does not automatically end your options.

In hit-and-run cases, we can often look for nearby surveillance or traffic camera footage, identify the license plate or vehicle involved, track down the owner of the vehicle, and determine whether there is any insurance coverage tied to the vehicle.

Sometimes coverage exists even when the driver tries to avoid responsibility. The key is acting quickly, because video footage and other evidence can disappear. If you were involved in a hit and run, it's worth having the situation reviewed before assuming there is no path forward.

If the driver stayed at the scene but did not have car insurance

If the other driver stopped but did not have insurance, that does not necessarily mean you are out of options.

Many people carry uninsured or underinsured motorist coverage, often called UM or UIM coverage. This type of insurance is designed for exactly this situation. It can help cover medical treatment and other damages when the at-fault driver has no insurance or not enough insurance.

Most people are not aware they even have this coverage until someone explains it to them. Look at the declaration page of your insurance policy or send it to us and we'll let you know if you carry uninsured/underinsured motorist insurance.

The bottom line

An uninsured driver does not automatically mean you have no case. There may be options through your own insurance, through identifying the vehicle owner, or through additional investigation. Each situation is different, and assumptions can lead people to give up on valid claims too early.

If the driver who hit you did not have insurance, talking it through can help you understand whether there are still paths available and what steps matter next.
